The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 15, 2022 SPR22/1772 Claudia Buruca Records Access Officer Suffolk County District Attorney’s Office One Bulfinch Place, Suite 300 Boston, MA 02114 Dear Ms. Buruca: I have received the petition of Shannon Dooling, of WBUR, appealing the response of the Suffolk County District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 22, 2022, Ms. Dooling requested “[a]ny and all Suffolk County District Attorney records pertaining to the homicide investigation of [a named individual] . . . filed and or dated between January 01, 2020 and the date of receipt of this records request.” Prior Appeal The requested records were the subject of a prior appeal. See SPR22/0724 Determination of the Supervisor of Records (April 7, 2022). In my April 7th determination, I found that the Office did not meet its burden under Exemptions (d) and (f) and ordered the Office to provide a response. On April 22, 2022, the Office responded and provided a further response on May 11, 2022. Unsatisfied with the Office’s responses, Ms. Dooling petitioned this office and this appeal, SPR22/1772, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and an Office representative, it is my understanding that the Office intends on providing a subsequent response to Ms. Dooling. Accordingly, the Office is ordered to provide Ms. Dooling with a response to his request in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Dooling may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1).
