The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 15, 2022 SPR22/1798 Stacy Book Compliance Officer III Massachusetts Parole Board 12 Mercer Road Natick, MA 01760 Dear Ms. Book: I have received the petition of William Nadworny appealing the nonresponse of the Massachusetts Parole Board (Board) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 17, 2022, Mr. Nadworny requested that, “… he is only requesting that the Board remove the April 19, 2022, Parole Decision forthwith from the agency website in accordance with CORI and Public Records Laws which protects the requestor from the posting of certain information on the Agency’s website outlined in this request.” Claiming to not yet have received a response, Mr. Nadworny, petitioned this office and this appeal, SPR22/1798, was opened as a result. Based on Mr. Nadworny’s correspondences requesting certain action from the Board, this office is unable to satisfy the request. This type of request is beyond the purview of the Public Records Division. This office has the statutory authority to determine the public status of records in Massachusetts. See G. L. c. 66, § 10(b). In compliance with the Public Records Law, the Supervisor of Records may only issue determinations where a violation of G. L. c. 66, § 10 has occurred. See G. L. c. 66, § 10A (a). Therefore, where it appears that no violation of G. L. c. 66, § 10 has been asserted in Mr. Nadworny’s correspondence, this office is unable to issue a determination at this time. .
