Johnson Town Clerk Town of Bourne 24 Perry Avenue Buzzards Bay, MA 02532 Dear Mr. Johnson: I have received the petition of Michael J. Rausch appealing the response of the Town of Bourne (Bourne) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 15, 2022, Mr. Rausch requested the following, “…all complaints filed with the Town of Bourne by any and all Bourne town employees against [named person].” The Town responded on July 29, 2022. Unsatisfied with the Town’s response, Mr. Rausch petitioned this office and this appeal, SPR22/1821, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Mr. Rausch. Accordingly, the Town is ordered to provide Mr. Rausch with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rausch may appeal the substantive nature of the Town’s response within ninety days.
