Iversen Records Access Officer Mayor’s Office City of Framingham 150 Concord Street Framingham, MA 01702 Dear Mr. Iversen: I have received the petition of Brian Petrini-Smith appealing the nonresponse of the City of Framingham (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 25, 2022, Mr. Smith requested various communications concerning the City’s staff. Claiming to not yet have received a response, Mr. Smith petitioned this office, and this appeal, SPR22/1837, was opened as a result. Subsequently, I learned that the City is aware of this appeal and is working on a response. In an email to this office dated August 23, 2022, the City states, “[t]he due date for [this] request is August 29th. The records will be provided to the requestor on or before that date.” Conclusion Accordingly, the City is ordered to provide Mr. Smith with said response in accordance with the Public Records Law, its Regulations and this order by August 29, 2022. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Smith may appeal the substantive nature of the City’s response within ninety days.
