Bouchard Records Access Officer City of Fall River One Government Center Fall River, MA 02722 Dear Ms. Bouchard: I have received the petition of Collin Dias appealing the response of the City of Fall River (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 29, 2022, Mr. Dias requested records from March 1, 2022 to June 29, 2022 as follows: [1] Any agreement [and] separation agreement between City and [named person]. [2] Any report or any record of investigation into… [named person] for Wrongdoing[.] The City provided a response on July 12, 2022. Unsatisfied with the response, Mr. Dias appealed and SPR22/1878 was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a City representative, it is my understanding that the City intends on providing a further response to Mr. Dias. Accordingly, the City is ordered to provide Mr. Dias with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Dias may appeal the substantive nature of the City’s response within ninety (90) days.
