See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 24, 2022, Mr. Norris requested the following records: [1] [a] copy of the policy regarding the duties of outside investigators and the commissioners investigators[;] [2] [a] copy of any Department policy granting authority for Department personnel to investigate behavior of an inmate/parolee and/or individual that occurred off Department property[;] [3] [a] copy of the number of inmates/residents who have tested positive for Covid in the months of June and July 2022[.] Claiming to not yet have received responsive records, Mr. Norris petitioned this office and this appeal, SPR22/1886, was opened as a result. Subsequently, it is my understanding the Department provided a response on August 25, 2022, to Mr. Norris’ request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Norris may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
