G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 14, 2022, Bera Dunau requested, “…any communications mentioning or addressed to [identified] Sgt. from May 1 of 2022 to July 14 of 2022.” The Department responded on July 29, 2022. Unsatisfied with the Department’s response, Bera Dunau petitioned this office and this appeal, SP22/1899, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Bera Dunau. Accordingly, the Department is ordered to provide Bera Dunau with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Bera Dunau may appeal the substantive nature of the Department’s response within ninety (90) days.
