The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 26, 2022 SPR22/1899 Chief Justin Litchfield Plainfield Police Department 315 Main Street Plainfield, MA 01070 Dear Chief Litchfield: I have received the petition of Bera Dunau, of the Daily Hampshire Gazette, appealing the response of the Plainfield Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 14, 2022, Bera Dunau requested, “…any communications mentioning or addressed to [identified] Sgt. from May 1 of 2022 to July 14 of 2022.” The Department responded on July 29, 2022. Unsatisfied with the Department’s response, Bera Dunau petitioned this office and this appeal, SP22/1899, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Bera Dunau. Accordingly, the Department is ordered to provide Bera Dunau with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Bera Dunau may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
