Stockley Town Clerk Town of Warren 48 High Street, P.O. Box 603 Warren, MA 01083 Dear Ms. Stockley: I have received the petition of Joseph F. Hennessey, Esq., appealing the response of the Town of Warren (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 9, 2022, Attorney Hennessey requested numerous records from the Warren Police Department. In his August 23, 2022 appeal, Attorney Hennessey requested, “…cruiser videos identified in paragraph 10, body camera videos identified in paragraph 11, [u]se of force reports identified in paragraph 12, [a]ll internal investigations conducted in connection to the identified incident in paragraph 14 and a copy of all text messages that were identified in para[graph] 15.” The Town responded on August 8, 2022 and August 19, 2022. Unsatisfied with the Town’s responses, Attorney Hennessey petitioned this office and this appeal, SPR22/1941, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Town representative, it is my understanding that the Town intends on providing a further response to Attorney Hennessey. Accordingly, the Town is ordered to provide Attorney Hennessey with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Hennessey may appeal the substantive nature of the Town’s response within ninety days.
