Littlehale Records Access Officer Newburyport Public Schools 70 Low Street Newburyport, MA 01950 Dear Mr. Littlehale: I have received the petition of Kathleen Logan appealing the response of the Newburyport Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 29, 2022, Ms. Logan requested “…a list of all programs, presentations, and/or courses related to sex education, including human sexuality, gender identity, sexual orientation, and/or abstinence, presented in grades K-12 in the Newburyport public school system from September 1, 2021 through June 30, 2022, and scheduled for September 1, 2022 through June 30, 2023. Please include each program’s title, author and presenter.” The School provided a response on July 14, 2022. Unsatisfied with the response provided, Ms. Logan petitioned this office and this appeal, SPR22/1943, was opened as a result. Subsequently, I learned that the School provided a further response to Ms. Logan on August 25, 2022. Where the basis of this appeal was opened as a result of the School’s July 14th response, I will now consider this administrative appeal closed. Ms. Logan may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
