Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite #7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Kate Wieneke appealing the nonresponse of the Massachusetts Bay Transportation Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 3, 2022, Ms. Wieneke requested “…all petitions for reconsideration of the June 15, 2022 FTA special directives, and all corrective action plans relating to the June 15, 2022 FTA special directives, and all corrective action plans submitted to, received, or approved by the FTA since January 1, 2018.” Claiming to not yet have received responsive records, Ms. Wieneke petitioned this office and this appeal, SPR22/1988, was opened as a result. Based upon a conversation between a Public Records Division staff member and a representative of the Authority, it is my understanding that the Authority intends on providing a response to Ms. Wieneke. Accordingly, the Authority is ordered to provide Ms. Wieneke with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Wieneke may appeal the substantive nature of the Authority’s response within ninety (90) days.
