Bouchard City Clerk Records Access Officer City of Fall River One Government Center Fall River, MA 02722 Dear Ms. Bouchard: I have received the petition of Jo C. Goode, of The Herald News, appealing the response of the City of Fall River (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 24, 2022 and June 27, 2022, Ms. Goode requested, “[i]nvestigation report regarding [identified] Director … including but not exclusive, of any recommendations of possible discipline if made in writing, including electronic communications that include emails.” The City provided responses on June 2, 2022 and July 12, 2022. Unsatisfied with the responses, Ms. Goode petitioned this office and these appeals, SPR22/2007 and SPR22/2008, were opened as a result. Based upon a communication between a Public Records Division senior attorney and a City representative, it is my understanding that the City intends on providing a further response to Ms. Goode. Accordingly, the City is ordered to provide Ms. Goode with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Goode may appeal the substantive nature of the City’s response within ninety (90) days.
