G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 17, 2022 and July 18, 2022, Ms. Carson requested documents concerning “the 1981 unsolved homicide of [an identified individual].” Specifically, Ms. Carson requested: 1. All documents regarding the Malafemmena, a Christ Craft boat operated by [an identified individual]. (Include, but not limited to, the following records for all items where applicable) a. Registration records b. Insurance records c. Police reports d. Court records e. Witness statements f. FBI reports 2. All documents regarding any other boat operated by [an identified individual]. 3. All documents regarding [an identified individual’s] gold charm bracelet. 4. All documents regarding [an identified individual’s] gray shoes. 5. All documents regarding the book Maya: Monuments of Civilization by Pierre Ivanoff. 6. All documents regarding the red silk jewelry pouch. 7. CIA summary report. 8. All documents regarding witness [an identified individual]. See SPR22/1838 and SPR22/1839 Determination of the Supervisor of Records (August 19, 2022). In my August 19th determination, I ordered the Office to provide Ms. Carson with a response to her request. On August 31, 2022, the Office responded. Unsatisfied with the response, Ms. Carson petitioned this office and this appeal, SPR22/2039, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and an Office representative, it is my understanding that the Office intends on providing a further response to Ms. Carson. Accordingly, the Office is ordered to provide Ms. Carson with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
