The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 20, 2022 SPR22/2044 Allison Mondello Primary Records Access Officer Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petition of Colman Herman appealing the response of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 18, 2022, Mr. Herman requested “…any and all records that indicate how much the officers working on the police escort for [named individual] were paid.” Prior Appeal The requested records were the subject of a prior appeal. See SPR22/2013 Determination of the Supervisor of Records (September 6, 2022). In my September 6th determination, I found that the Department had provided a further response to Mr. Herman on September 2, 2022, and closed the appeal. Unsatisfied with the Department’s response, Mr. Herman petitioned this office and this appeal, SPR22/2044, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Herman. Accordingly, the Department is ordered to provide Mr. Herman with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
