The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 20, 2022 SPR22/2067 Brona Simon State Historic Preservation Officer & Executive Director Massachusetts Historical Commission 220 William T Morrissey Blvd Boston, MA 02125 Dear Ms. Simon: I have received the petition of Christopher Patzke appealing the nonresponse of the Massachusetts Historical Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 24, 2022, Mr. Patzke requested “Guidelines For Implementation of Certified Local Government Programs as referenced in ‘Certification Agreement Between the Commonwealth of Massachusetts, By And Through The Massachusetts Historical Commission and City Of Salem’ signed by Michael Joseph Connolly, Secretary of State on February 19, 1991.” Claiming to not yet have received responsive records, Mr. Patzke petitioned this office and this appeal, SPR22/2067 was opened as a result. Subsequently, I learned that the Commission provided Mr. Patzke with a response dated September 10, 2022. Where the basis of this appeal was opened as a result of the Commission’s lack of a written response, I will now consider this administrative appeal closed. Mr. Patzke may appeal the substantive nature of the Commission’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
