DiBarri Northeast Metropolitan Regional Vocational Technical School 100 Hemlock Road Wakefield, MA 01880 Dear Superintendent DiBarri: I have received the petition of Mary Kate McGowan appealing the nonresponse of the Northeast Metropolitan Regional Vocational Technical School (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 19, 2022, Ms. McGowan requested “…School’s policies and procedures for special education including those stemming from the SEPPS (special education program plan statement).” Claiming to not yet have received responsive records, Ms. McGowan petitioned this office and this appeal, SPR22/2077, was opened as a result. Subsequently, a representative of the School provided a response on September 13, 2022, to Ms. McGowan’s request. Where the basis of this appeal was opened as a result of the School’s lack of a written response, I will consider this administrative appeal closed. Ms. McGowan may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
