The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 21, 2022 SPR22/2083 Helen Rush-Lloyd Records Access Officer Department of Public Health 250 Washington Street Boston, MA 02108 Dear Ms. Rush-Lloyd: I have received the petition of Eleonora Bianchi, of the New Bedford Light, appealing the non-response of the Department of Public Health (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 23, 2022, Ms. Bianchi requested the following records broken down by year: [1] All inmates declared dead by suicide while detained under Bristol County. The date range for this request is from 05/21/1997 to 08/23/2022. [2] All inmates declared dead by suicide while detained under Norfolk County. The date range for this request is from 08/23/2012 to 08/23/2022. [3] All inmates declared dead by suicide while detained under Suffolk County. The date range for this request is from 08/23/2012 to 08/23/2022. [4] All inmates declared dead by suicide while detained under Plymouth County. The date range for this request is from 08/23/2012 to 08/23/2022. Claiming to not yet have received responsive records, Ms. Bianchi petitioned this office and this appeal, SPR22/2083, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Ms. Bianchi with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. Ms. Bianchi may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
