Legislative Liaison and Public Records Officer Massachusetts Military Division 2 Randolph Road, Bldg. 1505 Hanscom, MA 01731-3001 Dear Attorney Cullen: I have received the petition of Tom Wall appealing the nonresponse of the Massachusetts National Guard (Guard) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 12, 2022, Mr. Wall requested records pertaining to the Melrose Armory Heating Replacement project including “[a]ll public certified payroll reports [and] [a]ll public certified payroll reports specific to installation of HVAC & Plumbing Insulation.” Claiming to not yet have received a response, Mr. Wall petitioned this office and this appeal, SPR22/2093, was opened as a result. Subsequently, I learned that a representative from the Guard intends on providing a written response to Mr. Wall. Accordingly, the Guard is ordered to provide Mr. Wall said response in accordance with the Public Records Law, its Regulations and this order within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Wall may appeal the substantive nature of the Guard’s response within ninety days. See 950 C.M.R. 32.08(1).
