Legal Counsel Department of State Police Crime Laboratory 124 Acton Street Maynard, MA 01754 Dear Attorney Griffin: I have received the petition of Mark Adams appealing the response of the Department of State Police Crime Laboratory (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 23, 2022, Mr. Adams requested: [1] All emails, files, notes records of [a named individual] from Massachusetts state police crime lab. [2] All emails and or notes of any sort drafted by, sent by or received by [a named individual] involving the case of [a named individual with identified case numbers]. [3] Any communications of any kind from anyone to or from [a named individual] in regard to [a named individual] and the toxicology report and any and all lab work of any nature… [4] [A]ll communications of any sort between [a named individual] and medical examiners office and any state employee as well. To include everything up to notes, messages about, emails, anything of any nature…All periods from 9/18/2018 through the present[.] Prior Appeal The requested records were the subject of a prior appeal. See SPR22/1922 Determination of the Supervisor of Records (August 31, 2022). In my August 31st determination, I ordered the Department to provide Mr. Adams with a response. On September 13, 2022, the Department provided a response. Unsatisfied with the Department’s response, Mr. Adams petitioned this office and this appeal, SPR22/2095, was opened as a result. SPR22/2095 Page 2 September 27, 2022 Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Adams. Accordingly, the Department is ordered to provide Mr. Adams with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Adams may appeal the substantive nature of the Department’s response within ninety days.
