The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 29, 2022 SPR22/2127 Helene Bettencourt Associate Commissioner Commissioner’s Office Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Brad Petrishen, of Worcester Telegram & Gazette, appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, §10A; see also 950 C.M.R. 32.08(1). On July 15, 2022, Mr. Petrishen requested: All records in the department’s possession (hard copies or electronic of any kind, including but not limited to, emails/test messages) that relate in any way to complaints regarding the license(s) of [named person]. That would include, but not be limited to, any complaints received from members of the public, as well as any department staff discussions/investigations/reasonably completed factual studies regarding that topic. On July 19, 2022, the Department responded and provided a further response on September 1, 2022. Unsatisfied with the Department’s responses, Mr. Petrishen petitioned this office and this appeal, SPR22/2127, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Petrishen. Accordingly, the Department is ordered to provide Mr. Petrishen with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Petrishen may appeal the substantive nature of the Department’s response within ninety days.
