Senior Counsel, Public Records and Records Management Massachusetts Department of Transportation 10 Park Plaza Boston, MA 02116 Dear Attorney Shorey: I have received the petition of Harry Mattison appealing the nonresponse of the Department of Transportation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 16, 2022, Mr. Mattison requested “[e]mails and their attachments sent to or from any email address ending in @hatch.com for 6/4/2021.” Claiming to not yet have received a response, Mr. Mattison petitioned this office and this appeal, SPR22/2137, was opened as a result. Subsequently, I learned that the Department intends on providing a written response to Mr. Mattison. Accordingly, the Department is ordered to provide Mr. Mattison with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Mattison may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
