G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv). On August 11, 2022, Lexi Fuller requested “…all correspondence, emails, frivolous complaints and all communication documents regarding [an identified physician].” Previous Appeal This request was the subject of a previous appeal. See SPR22/1934 Determination of the Supervisor of Records (September 2, 2022). In my September 2nd determination, I ordered the Board to provide Ms. Fuller with a supplemental response within ten business days. Subsequently, the Board petitioned this office for an extension of time, and this case was opened as a result. G. L. c. 66, § 10(c) As required by law, the Board must furnish a copy of this petition to the requestor. See G. L. c. 66, § 10(c) (“[t]he records access officer shall, upon submitting the petition to the supervisor of records, furnish a copy of the petition to the requestor”). Based on the documents provided in its petition, the Board has not demonstrated that it complied with this requirement of G. L. c. 66, § 10(c). Therefore, I am unable to opine on the Board’s petition at this time.
