Villani Town Administrator Town of Milford 52 Main Street, Room #11 Milford, MA 01757 Dear Mr. Villani: I have received the petition of James Wheelock appealing the response of the Town of Milford (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 25, 2022, Mr. Wheelock requested “…documentation formalizing how and when [Sacred Heart] [C]hurch was granted use of this and, that’s what I’m looking for. The church school has been closed for many years now, when will the [T]own ask the church to remove their fencing on public land, 42-0-357?” Prior appeal This request was the subject of a prior appeal. See SPR22/2016 Determination of the Supervisor of Records (Supervisor) (September 14, 2016). In my September 14th determination, I directed the Town to clarify if it possessed records responsive to Mr. Wheelock’s request. The Town provided a further response on September 16, 2022. Unsatisfied with the Town’s response, Mr. Wheelock petitioned the Supervisor, and this appeal was opened. Subsequently, it is my understanding that the Town intends on providing a subsequent response to Mr. Wheelock. Accordingly, the Town is ordered to provide Mr. Wheelock with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Wheelock may appeal the substantive nature of the Town’s response within ninety days.
