See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 18, 2022, Attorney Kaplan requested “information about the Commonwealth’s PASRR program and individuals receiving specialized services from the Department of Mental Health or the Department of Developmental Services.” On July 1, 2022, the Office responded. Unsatisfied with the Office’s response, Attorney Kaplan petitioned this office and this appeal, SPR22/2149, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and an Office representative, it is my understanding that the Office intends on providing a further response to Attorney Kaplan. Accordingly, the Office is ordered to provide Attorney Kaplan with said response in a manner consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Kaplan may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
