Conti Superintendent Burlington Public Schools 123 Cambridge Street Burlington, MA 01803 Dear Superintendent Conti: I have received the petition of Tim Kirchner, appealing the response of the Burlington Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 23, 2022, Mr. Kirchner requested the following records: [1] Any and all e-mails, sent by or received by, [named person], from June 21, 2022 through June 23, 2022, on the Burlington School Department’s electronic e- mail system. [2] [A]ny and all text messages sent or received, using school department issued cell phones, between the three named persons for the same time frame. [3] [A]ny and all reports, notes, documents, e-mails, etc, regarding an e-mail I sent to [named person] on or about September 30, 2021, regarding safety concerns at the Memorial School regarding a settlement agreement with the City and a named company. On September 14, 2022, the School responded. Unsatisfied with the School’s response, Mr. Kirchner petitioned this office and this appeal, SPR22/2158, was opened as a result. Based upon an email between a Public Records Division staff attorney and a School representative, it is my understanding that the School intends on providing a subsequent response to Mr. Kirchner. Accordingly, the School is ordered to provide Mr. Kirchner with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Kirchner may appeal the substantive nature of the School’s response within ninety days.
