G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 9, 2022, Mr. Michaud requested, “[r]ecords … for a composting operation in the Town of Dartmouth [including a specific] identifier to the records …” The Department responded on September 23, 2022. Unsatisfied with the response, Mr. Michaud petitioned this office and this appeal, SPR22/2191, was opened as a result. Subsequently, I learned that the Department provided a further response on September 27, 2022. Where the basis of this appeal was opened as a result of the Department’s September 23rd response, I will now consider this administrative appeal closed. Mr. Michaud may appeal the substantive nature of the Department’s September 27th response within ninety (90) days. See 950 C.M.R. 32.08(1).
