Jones City Clerk City of Newburyport 60 Pleasant Street Newburyport, MA 01950 Dear Mr. Chamberlain: I have received the petition of Keith Eddings appealing the response of the City of Newburyport (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 17, 2022, Mr. Eddings requested “…all records - including but not limited to emails, text messages, notes, memos and any other communications - between the Department of Public Services and representatives of the Newburyport Bank concerning the recent removal of trees by the bank outside its offices on State Street.” On August 22, 2022, the City responded and provided a fee estimate. Objecting to the fees, Mr. Eddings petitioned this office and this appeal, SPR22/2211, was opened as a result. Subsequently, I learned that the City responded to Mr. Eddings’ request with a further response sent on October, 11 2022. Where the basis of this appeal was opened as a result of the City’s August 22nd response, I will now consider this administrative appeal closed. Mr. Eddings may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
