Second Associate City Solicitor City of Springfield 36 Court Street, Room 210 Springfield, MA 01103 Dear Attorney Roche: I have received a petition on behalf of the City of Springfield (City) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv). As required by law, the City furnished a copy of this petition to the requestor. G. L. c. 66, § 10(c). On September 22, 2022, Attorney Donald C. Keavany, Jr. requested various categories of “emails between members of the Springfield City Council.” Concurrent with this petition, the City provided Attorney Keavany with a fee estimate on September 29, 2022. In an email to the City and this office on the same day, Attorney Keavany states that he “will accept this good faith estimate and will cut a check to the City.” In light of the above, it is unnecessary to opine on the City’s petition for permission to charge for time spent segregating or redacting responsive records. Further, this office encourages Attorney Keavany and the City to continue to communicate directly to facilitate providing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
