The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 14, 2022 SPR22/2216 Officer Mark Panagiotakos Records Access Officer Lawrence Police Department 90 Lowell Street Lawrence, MA 01840 Dear Officer Panagiotakos: I have received the petition of Severo Figueroa appealing the response of the Lawrence Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 25, 2022, Mr. Figueroa requested “a copy of the entire case file…any and all documentation related to [a specified incident], in which one [named individual] was killed.” The Department provided a response on September 7, 2022. Unsatisfied with the Department’s response Mr. Figueroa petitioned this office and this appeal, SPR22/2216, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Mr. Figueroa. Accordingly, the Department is ordered to provide Mr. Figueroa with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Figueroa may appeal the substantive nature of Department’s response within ninety days. See 950 C.M.R. 32.08(1).
