Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza, Suite # 7760 Boston, MA 02116 Dear Ms. Ciollo: I have received the petition of John Laliberte appealing the nonresponse of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 24, 2022, Mr. Laliberte requested “[t]he [identified] arbitration decision, MBTA v L589, issued 8/26/2022…” Claiming to not yet have received responsive records, Mr. Laliberte petitioned this office and this appeal, SPR22/2263, was opened as a result. Subsequently, I learned that the MBTA provided Mr. Laliberte with a response dated October 12, 2022. Where the basis of this appeal was opened as a result of the MBTA’s lack of a written response, I will now consider this administrative appeal closed. Mr. Laliberte may appeal the substantive nature of the MBTA’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
