Deree Town Clerk Town of Weymouth 75 Middle Street Weymouth, MA 02189 Dear Kathleen Deree: I have received the petitions of Gerard Mackin appealing the nonresponses of the Town of Weymouth (Town) to requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 21, 2022, Mr. Mackin requested documents regarding Spectra land purchase including “… all communications including exhibits and all responses between and among any or all council members and Mayor … regarding the communication by [named] Councilor.” Claiming to not yet have received responsive records, Mr. Mackin petitioned this office and these appeals, SPR22/2281 and SPR22/2284, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Town has provided a response(s). Accordingly, the Town is ordered to provide Mr. Mackin with a response(s) to the requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response(s) must be provided to this office. It is preferable to send an electronic copy of the response(s) to this office at pre@sec.state.ma.us. Mr. Mackin may appeal the substantive nature of the Town’s response(s) within ninety (90) days. See 950 C.M.R. 32.08(1).
