The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 12, 2022 SPR22/2287 Kim Gouveia Public Records Access Officer Middlesex County District Attorney Office 15 Commonwealth Avenue Woburn, MA 01801 Dear Ms. Gouveia: I have received the petition of Rich Saltzberg, of The Martha’s Vineyard Times, appealing the nonresponse of the Middlesex District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 13, 2022, Mr. Saltzberg requested “… any and all ballistic reports, crime scene analysis records, gunpowder analysis records, corresponding ATF records, and detailed written reasoning by a medical examiner for a cause of death relative to the 2019 firearm death of [a named individual].” Claiming to not yet have received a response, Mr. Saltzberg petitioned this office and this appeal, SPR22/2287, was opened as a result. Subsequently, I learned that the Office responded to Mr. Saltzberg’s request with a response sent on October 11, 2022. Where the basis of this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. Saltzberg may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
