Deree Town Clerk Town of Weymouth 75 Middle Street Weymouth, MA 02189 Dear Kathleen Deree: I have received the petitions of Gerard Mackin appealing the nonresponse of the Town of Weymouth (Town) to requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 29, 2022, Mr. Mackin requested documents regarding 30 Moore Rd Vitamin Sea including “… all documents indicating the maximum number of people allowed by the Town to assemble at one time in that part of the premises where alcohol is sold [and] … all reports of inspections of the board of health or licensing officer regarding the cleanliness and safety of the business activity on the subject premises.” Claiming to not yet have received responsive records, Mr. Mackin petitioned this office and these appeals, SPR22/2330 and SPR22/2331, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Mr. Mackin with a response to the requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Mackin may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
