G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 27, 2022, Mr. Russell requested the following records: [1] All communications via email, text or voice mail message pertaining to the eBook app ‘SORA’ and/or the MLS Commonwealth Ebook Collections: OverDrive K-12 Shared Sora Collection to parents, guardians, teachers and K-12 Newburyport Public School students during FY 2021 and FY 2022. [2] The contract entered into between the School and Over Drive Education to gain access to the MLS Commonwealth Ebook Collections: OverDrive K-12 Shared Sora Collection. [3] The total amount spent to date as of September 27, 2022 with Over Drive Education and the source of funding used [to] procure the MLS Commonwealth Ebook Collections: OverDrive K-12 Shared Sora Collection. [4] A complete list of books available for download by K-12 students by the MLS Commonwealth Ebook Collections: OverDrive K-12 Shared Sora Collection. Claiming to not yet have received a response, Mr. Russell petitioned this office and this appeal, SPR22/2337, was opened as a result. Subsequently, on October 25, 2022, I learned that the School intends on providing a written response to Mr. Russell. Accordingly, the School is ordered to provide Mr. Russell with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
