Cosgrove appealing the nonresponse of the Town of Wareham (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 31, 2022, Mr. Cosgrove requested the following records: [1] All records in connection with the engagement of an independent engineer/ firm to evaluate earth removal activity in Wareham in compliance with the Wareham Board of Selectmen’s instruction and the related 2021 Wareham Fall Warrant Article petition regarding same…[;] [2] All records by, from, and to A.D.M…concerning earth removal in Wareham…[;] [3] All records by, from any other person or entity…concerning earth removal in Wareham…[.] Claiming to not yet have received responsive records, specifically concerning items two and three of the request, Mr. Cosgrove petitioned this office and this appeal, SPR22/2350, was opened as a result. Subsequently, I learned that the Town intends on providing a response to Mr. Cosgrove. Accordingly, the Town is ordered to provide Mr. Cosgrove with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Cosgrove may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
