Records Access Officer Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza, Suite #7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Kerry Kavanaugh, of Boston 25 News, appealing the nonresponse of the Massachusetts Bay Transportation Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 18, 2022, Ms. Kavanaugh requested “…all correspondence between [named individuals] and anyone from the Federal Transit Authority between April 10, 2022 and August 18, 2022…” On September 15, 2022, Ms. Kavanaugh narrowed her request as follows: “…all correspondence between [named individuals] and anyone from the Federal Transit Authority between July 1, 2022 and August 18, 2022…” Claiming to not yet have received responsive records, Ms. Kavanaugh petitioned this office and this appeal, SPR22/2381, was opened as a result. Subsequently, it is my understanding the Authority intends on providing a subsequent response to Ms. Kavanaugh. Accordingly, the Authority is ordered to provide Ms. Kavanaugh with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Kavanaugh may appeal the substantive nature of the Authority’s response within ninety days.
