The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 4, 2022 SPR22/2413 Allison Mondello Primary Records Access Officer Massachusetts Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petition of Matthew Duffey appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 27, 2022, Mr. Duffey requested: All information related to the investigation of the homicide of [named person] in Brockton on June 5, 1999. The information sought includes, but is not limited to, copies of investigation notes, investigation reports, interview notes, interview summary reports, all written reports detailing any aspect of the investigation, charts, diagrams, all photographs including any photographs of firearms, surveillance videos, evidence analysis notes, evidence analysis reports (e.g., ballistics evidence), suspect lists, witness lists, witness interview summaries, witness interview notes, suspect interview summaries, and suspect interview notes [for] … the time period of June 5, 1999 to June 30, 2003... Claiming to not yet have received responsive records, Mr. Duffey petitioned this office and this appeal, SPR22/2413, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Duffey with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Duffey may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
