The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 10, 2022 SPR22/2446 Richard B. Jones City Clerk City of Newburyport 60 Pleasant Street Newburyport, MA 01950 Dear Mr. Chamberlain: I have received the petition of Keith Eddings appealing the response of the City of Newburyport (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 17, 2022, Mr. Eddings requested “…all records - including but not limited to emails, text messages, notes, memos and any other communications - between the Department of Public Services and representatives of the Newburyport Bank concerning the recent removal of trees by the bank outside its offices on State Street.” Prior Appeal The requested records were the subject of a prior appeal. See SPR22/2211 Determination of the Supervisor of Records (October 13, 2022). In my October 13th determination, I found that the City provided a further response on October 11, 2022, which included a revised fee estimate and closed the appeal. Objecting to the fees, Mr. Eddings petitioned this office and this appeal, SPR22/2446, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Eddings. Accordingly, the City is ordered to provide Mr. Eddings with a response to his request. said response must be provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Eddings may appeal the substantive nature of the City’s response within ninety days.
