The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 9, 2022 SPR22/2457 Ben Kaufman Town Clerk Town of Brookline 333 Washington Street Brookline, MA 02445-6853 Dear Mr. Kaufman: I have received the petition of Jeremy Margolis appealing the nonresponse of the Town of Brookline (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 24, 2022, Mr. Margolis requested: [1] All emails (and their attachments) sent by [named Town] employees . . . to employees of Comprehensive Investigations and Consulting, LLC from July 15, 2022 to October 7, 2022; and [2] All emails (and their attachments) received by [Town] employees . . . that were sent by employees of Comprehensive Investigations and Consulting, LLC from July 15, 2022 to October 7, 2022. In his October 24th request to the Town and sent to the Town’s Solicitor’s Office, Mr. Margolis states, “[t]his (narrowed) request was submitted to [the Solicitor’s Office] on Friday, October 7, 2022. The deadline for a response was Friday, October 21, 2022.” After a telephone call from the Solicitor’s Office to Mr. Margolis on October 27th, Mr. Margolis sent his request again. Having not received a response, Mr. Margolis petitioned the Supervisor of Records on October 30th, and this appeal was opened. Based upon a conversation on November 8, 2022, between a Public Records Division senior attorney and a representative of the Town, it is my understanding that the Town intends on providing Mr. Margolis with a response to his request. Conclusion Accordingly, the Town is ordered to provide Mr. Margolis with said response to his One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Ben Kaufman, Town Clerk SPR22/2457 Page 2 November 9, 2022 request in a manner consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. Mr. Margolis may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Manza Arthur Supervisor of Records cc: Jeremy Margolis
