G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 28, 2022, Attorney Vickery requested “… copies of any and all public records reflecting or embodying the decision to stop publishing data on COVID-19 breakthrough cases, including but not limited to memoranda, reports, and emails.” The Department responded on August 11, 2022. Unsatisfied with the response, Attorney Vickery petitioned this office and this appeal, SPR22/2481, was opened as a result. In an email dated November 2, 2022, Attorney Vickery informed this office that he wishes to withdraw his appeal. Accordingly, I will consider this administrative appeal closed.
