Cruise City Clerk City of Brockton 45 School Street Brockton, MA 02301 Dear Mr. Cruise: I have received the petition of Michael Berger appealing the nonresponse of the City of Brockton (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 17, 2022, Mr. Berger requested all insurance policy documentation used to insure the Brockton Police Department including its vehicles during a specific time period. Claiming to not yet have received responsive records, Mr. Berger petitioned this office and this appeal, SPR22/2485, was opened as a result. Subsequently, I learned that the City provided Mr. Berger with a response dated November 2, 2022. Where the basis of this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Berger has appealed the City’s November 2nd response which is in the process of being opened as a new appeal.
