Scanlan Assistant General Counsel Executive Office of Health and Human Services 1 Ashburton Place Boston, MA 02108 Dear Attorney Scanlan: I have received the petition of Paxton Strout appealing the nonresponse of the Executive Office of Health and Human Services (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 12, 2022, Mr. Strout requested 11 categories of records in 2022 regarding Supervised Consumption Sights, the budget from the Harm Reduction Initiative and any Berkshire County specific statistics. Claiming to not yet have received a response, Mr. Strout petitioned this office and this appeal, SPR22/2500, was opened as a result. Subsequently, I learned that the Office provided a response to Mr. Strout on November 15, 2022. Where the basis of this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. Strout may appeal the substantive nature of the Office’s response within 90 days. See 950 C.M.R. 32.08(1).
