See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 9, 2022, Ms. McDermott requested records relating to ten named individuals who were investigated for officer involved deaths. Previous appeals This request was the subject of previous appeals. See SPR22/1671 Determination of the Supervisor of Records (August 3, 2022) and SPR22/2105 Determination of the Supervisor of Records (September 28, 2022). The Department responded on October 19, 2022. Unsatisfied with the response, Ms. McDermott petitioned this office and this appeal, SPR22/2502, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Ms. McDermott. Accordingly, the Department is ordered to provide Ms. McDermott with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. McDermott may appeal the substantive nature of Department’s response within ninety days.
