Senior Counsel, Public Records and Records Management Office of General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Shorey: I have received the petition of Geraldine Mullaly appealing the nonresponse of the Massachusetts Department of Transportation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 5, 2022, Ms. Mullaly requested documents and information relevant to the South Coast Rail Project. Claiming to not yet have received responsive records, Ms. Mullaly petitioned this office and this appeal, SPR22/2508, was opened as a result. Subsequently, I learned that the Department provided Ms. Mullaly with a response dated October 5, 2022. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Mullaly may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
