Deree Town Clerk Town of Weymouth 75 Middle Street Weymouth, MA 02189 Dear Ms. Deree: I have received the petition of Attorney Mark Miller appealing the nonresponse of the Town of Weymouth (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 29, 2022, Attorney Miller requested the following records for a specific accident in 2022: [1] Any and all photographs, video camera footage, or visual recordings … [2] All recordings of any police calls, dispatches, verbal communications, or conversations … [3] A copy of a police report… including any supplemental reports. [4] Any and all witness statements … as well as the names and addresses of any witnesses. Claiming to not yet have received responsive records, Attorney Miller petitioned this office and this appeal, SPR22/2532, was opened as a result. Subsequently, I learned that the Town provided Attorney Miller with a response dated November 10, 2022. Where the basis of this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Attorney Miller may appeal the substantive nature of the Town’s November 10th response within ninety (90) days. See 950 C.M.R. 32.08(1).
