The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 22, 2022 SPR22/2543 John Pyers Executive Secretary City of Lowell 375 Merrimack Street, #3 Lowell, MA 01854 Dear Mr. Pyers: I have received the petition of Laura Ortiz appealing the response of the City of Lowell (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 6, 2022, Ms. Ortiz requested, various records related to polling locations and voting procedures used by the City. The City provided a response on September 15, 2022. Unsatisfied with the City’s response, Ms. Ortiz petitioned this office and this appeal, SPR22/2543, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Ms. Ortiz. Accordingly, the City is ordered to provide Ms. Ortiz with said response to her request, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Ortiz may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
