Cohen Records Access Department Department of Environmental Protection 1 Winter Street Boston, MA 02108 Dear Ms. Cohen: I have received the petition of Mr. Christopher Michaud appealing the nonresponse of the Department of Environmental Protection (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 28, 2022, Mr. Michaud requested: [1] When the proposed regulation being 314 CMR 21.00 and proposed revisions to 310 CMR 15.00 were submitted to Administration and Finance for review… [2] Comments from Administration and Finance in response to the proposed regulations being 314 CMR 21.00 and proposed revisions being 310 CMR 15.00… Claiming to not yet have received responsive records, Mr. Michaud petitioned this office and this appeal, SPR22/2578, was opened as a result. Subsequently, the Department provided Mr. Michaud with a response dated November 21, 2022. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed. Mr. Michaud may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
