The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 30, 2022 SPR22/2580 Rachel Cohen Records Manager Department of Environmental Protection One Winter Street Boston, MA 02108 Dear Ms. Cohen: I have received the petition of Christopher Michaud appealing the response of the Department of Environmental Protection (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 30, 2022, Mr. Michaud requested records including records related to the Nitrogen Sensitive Area Subcommittee, responses by the Department to comments made by two identified individuals, leachate, groundwater and storm water runoff testing data, and copies of any groundwater discharge permit. On September 14, 2022, the Department responded. Unsatisfied with the Department’s response, Mr. Michaud petitioned this office and this appeal, SPR22/2580, was opened as a result. Subsequently, I learned that the Department provided a further response dated November 29, 2022 to Mr. Michaud. Where this appeal was opened as a result of the Department’s September 14th response, I will now consider this administrative appeal closed. Mr. Michaud may appeal the substantive nature of the Department’s November 29th response within ninety (90) days. See 950 C.M.R. 32.08(1).
