Barrett Kornitsky, LLP 1 Essex Green Drive #4 Peabody, MA 01960 Dear Attorney Barrett: I have received the petition of Mary-Ellen Manning, Esq. appealing the response of the City of Peabody (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 20, 2022, Attorney Manning requested “all documents reflecting the dates and hours [worked by an identified person], and indicate whether [the identified person] was working on site at [the City Hall] or remotely during the period of March 20, 2021 through April 1, 2021.” The City denied the request in its entirety under Exemption (c) of the Public Records Law. As a result, Attorney Manning petitioned the Supervisor of Records, and this appeal was opened. Based on a conversation between a Senior Attorney in the Public Records Division and an attorney for the City, it is my understanding that the City intends on providing a further response to Attorney Manning. Conclusion Accordingly, the City is ordered to provide Attorney Manning with said response to her request, provided in a manner consistent with the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Manning may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
