The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 1, 2022 SPR22/2654 James Cummings Sheriff Barnstable County Sheriff’s Office 6000 Sheriff’s Place Bourne, MA 02532 Dear Sheriff Cummings: I have received the petition of Steven Smith appealing the response of the Barnstable County Sheriff’s Office (Office) to a request for public records. G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On October 13, 2022, Mr. Smith requested: [1.] A copy of Trinity Foods menus for all diets, pricing lists, calorie and nutritional information, contracts, as well as for staff and inmate [2.] A copy of any and all grievances [Mr. Smith has] filed on correctional officers and/or on Trinity Foods or against the kitchen/staff [3.] Any grievances… sent to [named individual]… in regards to [Mr. Smith]… [4.] …all other grievances [Mr. Smith] filed at Suffolk Jail… The Office responded on October 26, 2022. Unsatisfied with the Office’s response, Mr. Smith petitioned this office and this appeal, SPR22/2654, was opened as a result. Subsequently, I learned that the Office provided a further response on November 29, 2022. Where this appeal was opened as a result of the Office’s October 26th response, I will now consider this administrative appeal closed. Mr. Smith may appeal the substantive nature of the Office’s November 29th response within ninety (90) days. See 950 C.M.R. 32.08(1).
