Benson appealing the response of the Acton- Boxborough Regional School District (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 16, 2022, Mr. Benson requested, “…any and all text messages exchanged between [named persons] during the October 15, 2020, meeting of the Acton Boxborough Regional School Committee …” The School responded on August 29, 2022 and September 19, 2022. Unsatisfied with the responses, Mr. Benson petitioned this office and this appeal, SPR22/2664, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a School representative, it is my understanding that the School intends on providing a further response to Mr. Benson. Accordingly, the School is ordered to provide Mr. Benson with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Benson may appeal the substantive nature of the School’s response within ninety (90) days.
